What You Should do Following a Car Accident

If you’re a driver involved in a car accident in Florida, and the crash resulted in injury and/or vehicle damage or damage to any other property in an apparent amount of at least $500, you must report the accident to the local police department. These rules can be found at Florida Statutes section 316.065.

If you are injured or in any type of discomfort after a car accident, the first thing you should do is seek medical treatment. It is recommended that you are medically evaluated as soon as possible and not wait for the pain or symptoms to persist.

After a car accident, the extent of your injuries is not entirely known right away. Many times, when one is involved in a car accident, initial symptoms may not be felt because of adrenaline pumping through your body, subsiding some pain and symptom. However, this does not mean that you may not be suffering from injuries as a result of a car accident. You should also seek medical attention soon after the accident. A delay in medical treatment after a car accident may be used as a defense against you later on in litigation. This is a point that defense attorneys love to use to minimize your legitimate injuries after a car accident.

Take pictures at the scene of the car accident. After the car accident and once you have accessed that you are safe, take pictures of the damages to the vehicles involved in the car accident, pictures of any people that were involved in the accident, pictures of area of where the accident took place. If the other driver involved in the car accident tells you that they did not see you because of xyz, then try to take pictures of what they are talking about. These photographs will assist in proving liability against the other driver and show that you are not at fault for the car accident.

Gather information of those involved. If you can and if it is safe, attempt to take the information about the other drivers involved in the car accident. The information you should ask for is the following:

   · Names

   · Picture of their Drivers License

   · Proof of Insurance

   · Name of any witnesses

   · Statements that the other driver or witnesses made at the scene

Miami Personal Injury Protection (PIP) Lawyer

Due to Florida law, every driver in Florida is required to maintain Personal Injury Protection (PIP) insurance that covers $10,000. Since Florida follows a “no fault” rule when it comes to car insurance policy, PIP provides you with protection regardless of who is at fault.
However, you must meet specific requirements for PIP to kick in. For full benefits, you need to have an “emergency medical condition” and seek treatment within 14 days of your car accident.

Regardless of your situation, PIP does not pay over $10,000 and does not cover all expenses — this policy covers 80% of your medical costs and 60% of your lost wages.

This policy does not pay for your car repairs or any further damages you may need.

As you already know, a couple of medical bills can easily go over the set $10,000 amount. When you maintain serious injuries, PIP will simply not be enough. You may need to pursue claims with the other party’s insurance company.

Filing a PIP claim and pursuing further compensation can be complicated. Between doctor’s visits and family responsibilities, you might not even have the time to file paperwork or undergo a legal proceeding.

With the help of a skilled car accident attorney, you can focus on what really matters — your recovery and your family’s well-being.
